TERMS & CONDITIONS OF SERVICE
Kaprijke Logistics and Freight Forwarding Limited
1. Definitions
• “Company” means Kaprijke Logistics and Freight Forwarding Limited, its agents, employees, and authorized representatives.
• “Customer” means any individual or entity requesting or using the Company’s services.
• “Shipment” means any package, barrel, cargo, document, freight, or item handled by the Company.
• “Carrier” means the airline, shipping line, trucking company, or other transport provider used.
• “Services” include shipping, freight forwarding, customs clearance, warehousing, and delivery services offered by the Company.
2. Limitation of Liability
2.1 Kaprijke Logistics and Freight Forwarding Limited acts only as an intermediary between the Customer and Carriers and is not liable for loss, delay, or damage caused by Carriers, customs authorities, port operations, weather, natural disasters, or other events outside its direct control.
2.2 All shipments move entirely at the Customer’s risk, unless the Customer purchases declared value protection or insurance in writing and pays the applicable fees.
2.3 The Company’s liability, if any, shall not exceed the lesser of:
• The declared value (if insurance was purchased), or
• USD $100 per shipment where no insurance was purchased.
2.4 The Company shall not be liable for consequential, indirect, or economic losses, including but not limited to loss of profit, loss of business, or penalties due to delay.
3. Customer Responsibilities
3.1 The Customer must ensure that all goods are properly packed, labeled, and suitable for transport.
3.2 The Customer is responsible for providing accurate information, including item descriptions, values, personal information, and documentation required by customs.
3.3 The Customer agrees to comply with all local and international laws, including import restrictions, prohibited items, and customs regulations.
3.4 The Customer is responsible for payment of all duties, taxes, storage fees, inspection fees, penalties, and charges imposed by customs or third-party agencies.
4. Prohibited and Restricted Items
4.1 Kaprijke Logistics and Freight Forwarding Limited reserves the right to refuse or reject any shipment containing prohibited items under:
• International Air Transport Association (IATA) rules
• International Maritime Organization (IMO) regulations
• Local customs laws
4.2 Prohibited items include (but are not limited to):
• Firearms, ammunition, explosives
• Illegal drugs or controlled substances
• Hazardous materials not declared
• Perishable goods without proper preparation
• Cash or high-value jewelry without written approval
4.3 If prohibited items are discovered, the Company may detain, return, or surrender the shipment to authorities without liability.
5. Customs Clearance & Inspection
5.1 The Customer authorizes Kaprijke Logistics and Freight Forwarding Limited or its agents to act as their representative for customs clearance.
5.2 Customs authorities may inspect shipments at their discretion, and the Company shall not be responsible for delays, seizures, or additional charges resulting from such inspections.
5.3 All customs assessments are final, and the Customer must pay all applicable duties and fees before release of goods.
6. Shipping Times & Delays
6.1 All transit times provided by Kaprijke Logistics and Freight Forwarding Limited are estimates only and not guaranteed.
6.2 The Company is not liable for delays caused by:
• Port congestion
• Customs processing
• Carrier schedules or cancellations
• Weather or natural disasters
• Mechanical failures
6.3 No refunds are provided for delay unless expressly agreed in writing.
7. Fees, Payments & Non-Refundable Charges
7.1 All service fees, freight charges, and customs-related expenses must be paid in full before release or delivery of shipments.
7.2 All payments are non-refundable, including deposits, handling fees, warehouse fees, and processing charges.
7.3 Storage fees apply to shipments left beyond the specified free period, and Kaprijke Logistics and Freight Forwarding Limited may dispose of unclaimed cargo after 30 days, applying proceeds toward unpaid charges.
8. Delivery & Pickup
8.1 Delivery services, if offered, are performed on a “best-effort” basis.
8.2 Customers must inspect goods upon pickup or delivery. Claims for visible damage must be reported immediately, and no later than 24 hours after receipt.
8.3 If delivery is attempted but unsuccessful due to Customer unavailability or incorrect address, redelivery fees may apply.
9. Insurance
9.1 Insurance is optional and must be requested and paid for before shipment departs.
9.2 If no insurance is purchased, the Customer acknowledges and accepts that the shipment travels entirely at their own risk.
10. Claims & Complaints
10.1 All claims must be submitted in writing within:
• 24 hours for visible damage
• 7 days for concealed damage
• 14 days for loss or non-delivery
10.2 Claims must include photos, receipts, and supporting documentation.
10.3 Filing a claim does not guarantee compensation. Any compensation shall not exceed the limits set out in Section 2.
11. Right of Refusal
Kaprijke Logistics and Freight Forwarding Limited reserves the right to refuse service to any Customer or shipment for safety, legal, operational, or compliance reasons.
12. Governing Law
These Terms & Conditions are governed by the laws of Jamaica, and any disputes shall be resolved in the courts of Jamaica.
13. Amendments
Kaprijke Logistics and Freight Forwarding Limited may update or modify these Terms & Conditions at any time. Updated versions become effective upon posting or distribution.
